If a citizen files a petition for his/her spouse who is already in the US and working illegally, what happens?

Will they reject the aplication?

Will the alien and employer get in trouble?

Will they give him/her a work authorization?

Will they adjust his/her status anyways? If a citizen files a petition for his/her spouse who is already in the US and working illegally, what happens?
The foreign spouse will be allowed to stay in the US and adjust status in this case because the original arrival was legal. File forms I-130, I-485, I-765, I-864 and G-325A all at the same time, in the same envelope. The total fees is $1,345.

In cases where the foreign spouse comes over the border illegally (uninspected) he/she is forced to leave the United States and attempt to get the visa in his/her own country. This greatly complicates the process. If a citizen files a petition for his/her spouse who is already in the US and working illegally, what happens?
Will the alien and employer get in trouble? The employer is already breaking the Law.

The Citizen is in conflict of the law by, Harboring, transporting and abetting. All felony offenses,

Working illegally, means either working under the table or has a stolen SSN. Felony.

To legally be married to a Legal Immigrant, a marriage application has to be filed with Immigration and Naturalization.

The best bet is, the Illegal go back to their country and do it right.

In time, you all will be found out and will both loose. The deported Illegal won't be eligible to legally apply for 10 years and the Citizen can be looking at prison time.

Check the link for the laws regarding this.
It all depends on the interviewer at the USCIS office. I am serious.

If you've done everything else above-board and legally, you've got a shot.

Best of luck, but you should've waited until your work permit came in. My husband is a Canadian immigrant, and we had to make do with my income until his permit came in. It was tough, but we did it. Follow the law and you won't have to worry about this.

By the way, if you came here as a tourist and got married, you're going to have to prove that you TRULY came here as a tourist and did NOT come here with the intention of getting married. If you cannot prove this, you will be asked why you didn't get a fiance visa instead, and you will most likely have your application rejected. As it should be.
The way illegals are allowed to pour into our country, I doubt if anything is done about it. Why don't you chance it and see how far you get? With any luck, both of you will get sent back.
